California Duty to Defend Reform (SB 496): An overview post January 1, 2018
This program provides a brief overview of contractual defense and indemnity as well as a short historical summary of California indemnity law and the efforts to address the uninsurable contractual defense obligation for design professionals. The program provides a detailed analysis of Senate Bill 496 and the changes to California Civil Code Section 2782.8. The two prevailing and competing interpretations of the Civil Code are discussed against the backdrop of various contractual indemnity provisions that have arisen in response to the amended code section. The last part of the program emphasizes contracting best practices and how an insurable contract can benefit clients and design professionals.
