Everything You Need to Know About Design Professional Agreements
This fast paced session will run the gamut from foundational principles of contract law through the core clauses of greatest impact in design agreements and the enhancement clauses of greatest value (or danger). From there the course will diverge into an even more challenging discussion as design professionals preparing to act as a "team" apply these same contact principles and other points of self-protection against one another. Finally, the program will play these principles into alternative agreement contexts such as master service agreements. Each milestone in the journey will be illustrated by stories of relationships and projects gone wrong along with the corresponding contract options, strategies, and solutions.
- Master the foundational legal principles leading underlying contract formation and implementation.
- Distinguish the core contract issues of greatest impact and the enhancing or danger clauses beyond the core.
- Develop a balanced approach to the application of core contract strategies to the design team relationship.
- Apply the core contracting concepts to alternative arrangements such as master service agreements and design-build.
