This seminar will apply Sun Tzu's "Art of War" to negotiating the design professional contract. Sun Tzu says: "The general who wins the battle makes many calculations in his temple before the battle is fought. The general who loses makes but few calculations beforehand." With a modern interpretation by Sigmund Freud, Sun Tzu's strategies and tactics can still resonate today. Your client is as much of an enemy as a friend; therefore, successful contractnegotiation is not just about your fees, but increasingly about risk allocation, indemnity and future law suits.
• Know and understand applicable state statutes which affect contractual rights
• Understand how your contract can affect the standard of care and increase risk
• Understand how your scope of work and contract clauses can impact the A/E bottom line
• How best to address indemnity provisions in A/E contracts for services
