Ambiguous data and data open to interpretation, can set the stage for potential conflict both in terms of technical interpretation as well as legal interpretation. This discussion will provide insights to the types of ambiguous data and information/situations that the professional might encounter on
differing types of projects, the effects on one's professional opinion, and approaches that can be used to resolve or reduce ambiguities.

Specialists in professional liability will present a claims case study "You Are Toast" which highlights an architect hired under a master agreement by a national fast food franchisor to design all of its franchisees' build-outs. During subsequent negotiation with one franchisee, the architect agreed to remove CA from its scope of services in exchange for a reduced fee. Not long after occupancy, the franchisee experienced several electrical issues. A year after completion, the building burned to the ground, resulting in cross-complaints by multiple parties and several years of litigation.

The California Board for Professional Engineers, Land Surveyors, and Geologists has the authority to investigate complaints of violations of the Professional Engineers Act, the Professional Land Surveyors' Act, and the Geologist and Geophysicist Act. This discussion will include potential enforcement actions including suspending or revoking licenses, criminal prosecution and how the Board regulates the practices of our professions.
